Gentlemen:

I refer to your letter dated July 3rd 2017 requesting, “…a thorough review by the WBO for possible miscalls of the referee where some deductions were not made and of the judges in their judging that have caused varying opinions on their objectivity.

We are making this request for a review, which may call for sanctions on the referee and judges if so warranted, in furtherance of our mutual goal of protecting the integrity of the sport and even more improving the boxing industry that we all love.”

We must make it clear that an Official’s discretion, whether Judge or Referee, is irrevocable. The decision of an Official should only be revoked when fraud or violations of the Law occur. I assure you that the Officials who participated in this fight are all professional, distinguished, honest and honorable human beings. Can you imagine the Nevada State Athletic Commission investigating Referee Tony Weeks because he did not deduct points during the Kovalev fight!

The World Boxing Organization does not have jurisdiction in the first instance to revoke any decision, as that would correspond to the Australian National Boxing Federation.

I would be very grateful if the Philippines Games and Amusements Board (GAB) can provide any evidence indicating fraud or violation of Law. Please forward it immediately to the Australian National Boxing Federation and to the WBO so that we may proceed accordingly.

Although this is the situation, as I previously publicly stated, we will appoint five (5) anonymous competent Judges from different countries to watch the bout without sound distraction. Then, we will tabulate the results to ascertain clearly which rounds each fighter won using an average scale based on 60, 80 and 100 per cent. This means that 3 of the 5 officials have to agree to determine which fighter won the round.

The purpose of this review is to be able to give the fans certainty of who was the winner of the bout, even though we do not have the power to reverse the decision of the Judges based on discretion and, in this case, we do have a rematch clause on the fight contract.

I take this opportunity to wish you success in all your endeavors and tell you that I was most pleased to have had the opportunity of personally greeting you in Australia last week.

We received an email from the Manager of Amanda Serrano, advising that the current Female Jr. Featherweight Champion, be considered as the Mandatory Challenger for the WBO Female Bantamweight Division. The Committee voted and agreed by unanimous decision.

El pasado 13 de febrero de 2017 les fue notificado el resultado de la votación del Comité de Campeonatos determinando a la campeona de la división “Jr. Featherweight” (122 lb.) como la retadora mandataria contra la actual campeona división “Bantamweight” (118 lb.) Sabrina Pérez.

Conforme a ello se concedió el término de 15 días calendario con el propósito de que establecieran negociaciones para el encuentro y defensa del título que ostenta Sabrina Pérez en dicha división y de no culminar las negociaciones en dicho término se ordenaría una subasta.

Sirva la presente a manera de recordatorio que el término concedido para las negociaciones está vencido y se solicita que dentro de las próximas 48 horas nos indiquen el resultado de dichas negociaciones, ya que de no recibirse notificación alguna se ordenará la celebración de una subasta durante los próximos 10 días, conforme los términos establecidos en nuestra comunicación del pasado 13 de febrero de 2017.

WBO Kids Drug Free visits Panama and Colombia

Once again the WBO is proud to have had the opportunity to contribute through the Kids Drug Free program in different countries across the world. This time we visited Panama and Colombia to contribute with exemplary organizations that work every day to make a difference in the lives of many children.

Round 1: San José de Malambo Orphanage

As promised in January of this year, the WBO revisited this past Monday, March 6th, the San José de Malambo Orphanage in Panama, a non-governmental organization that looks out for children and teens in vulnerability conditions, this time with the purpose of donating backpacks that the children need to attend school.

Education is an important tool to keep children away from the streets; we sincerely admire the work done by the Sisters that run this institution and that give children here love, attention, and a chance of a better life.

Round 2: FUNVIVIR

Our next stop on Tuesday, March 7th, was in Cartagena, Colombia, where we were received by the dedicated personnel of FUNVIVIR, a non-profit organization founded in 2006 with the purpose of assisting children battling cancer and their families who have limited resources and many necessities that become more evident when dealing with the illness and undergoing treatment. The WBO had already visited this institution back in March of 2016.

The donation was given at the Bernardo Caraballo Coliseum. This organization was picked in life by our friend and colleague Luis Pérez, who recently passed away victim of cancer; this made the activity much more meaningful for all of us.

All children battling cancer are true fighters, especially when they are faced with limitations and difficult financial realities; the WBO congratulates FUNVIVIR for their wonderful work and joins them in their noble mission to alleviate the immediate needs of these young fighterscolombia

Este jueves 19 de enero 2017 el Orfelinato San José de Malambo, en El Carrizal, Arraiján, volvió a recibir una donación económica por parte de la Organización Mundial de Boxeo (OMB), por medio de su presidente,  Francisco ‘Paco’ Valcárcel quien ademas fue acompañado por el Lic. Luis Batista Salas, Presidente Fundador de la OMB y Presidente del Comité de Campeonatos Mundiales, junto a Joe Hernández y Rubén De Jesús, cercanos colaboradores de la Organización y don Marco Hermoso representante de la OMB en Panamá quien escogió al Orfanato de Malambo para recibir la donación.

“Es un compromiso que tenemos y pasamos por varios países”, dijo el dirigente de la OMB, programa conocido como Kids Drug Free y que esta semana se llevo acabo importantes donaciones en los países hermanos de Costa Rica y Nicaragua. Mientras, Sor Lourdes, anfitriona hace muchos años de esta organización, agradecía a la entidad boxística, este hogar es casa para niños y jóvenes huérfanos y que algunos inclusive tienen que enfrentar enfermedades como el Sida, por lo que la ayuda siempre es importante para seguir con tan importante labor que conlleva gastos diarios.

Como parte importante del acto realizado ayer en la entrega de la donación, también se recordó a Luis Pérez, un miembro importante en la consolidación mundial de la OMB, quien perdió la batalla con el cáncer el pasado mes de diciembre y que siempre en vida apoyo el programa Kids Drug Free en Panamá.

Dear World Champion Fury:

We are very sorry to hear the reports that you have allegedly pulled out of the October 29th bout due to a serious depression you are being treated for. Please know that all at the WBO are concerned for you and wish you the best for a full and complete recovery.

As you know, since the date your title was won on November 28, 2015, you have not defended your title and you have been inactive. On Jun 24, 2016, an ankle injury forced you to withdraw from your Heavyweight rematch against Wladimir Klitschko scheduled for July 9th in Manchester. Now, two months later, according to Mail Online your camp has announced the following:

“It is with the deepest regret that we have to announce that the world heavyweight championship rematch between Tyson Fury and Wladimir Klitschko, scheduled to take place on the 29th October 2016 at the Manchester Arena, will not be going ahead,”

Tyson has, this week, been declared medically unfit to fight. Medical specialists have advised that the condition is too severe to allow him to participate in the

rematch and that he will require treatment before going back into the ring. Tyson will now immediately undergo the treatment he needs to make a full recovery.”

The WBO World Championship Committee will need to receive your Interim Certification within 10 calendar days of this letter, non-extendable. This information is needed for the Committee to evaluate your condition appropriately within the division and to consider your status consistent with our World Championship Rules.

Rule 19 of the WBO Regulations of World Championship Contests provides:

“SECTION 19. FAILURE OF THE CHAMPION TO COMPLY WITH THE TERMS OF A WORLD CHAMPIONSHIP CONTRACT OR THE WORLD CHAMPIONSHIP RULES

(b) However, if the Champion is unable to defend his Championship within the time periods provided in these Rules because he is physically disabled for a justified cause, and said disability has been verified and accepted by the World Championships Committee, the Champion may be granted a reasonable time to recover from the disability and retrain to competitive condition, which shall not in total exceed 180 days. The disability extension will be granted only if the Committee determines, based on competent medical advice, that the Champion is reasonably expected to recover from his disability within the maximum allowable term of the disability extension. The Committee may condition its approval of a disability extension upon the Champion providing interim medical certifications that he is reasonably expected to recover within the term of the disability extension.

(c) A disability extension shall be approved only by the vote of the World Championships Committee. If the Champion’s recover time exceeds the maximum term of the disability extension, or if upon receipt of an interim medical certification the World Championship Committee determines that the Champion is not reasonably likely to recover and be prepared to defend his Championship within the term of the disability extension, the title shall be declared vacant and a Vacant or Interim Championship fight, as the case may be, shall be held for the title pursuant to the provisions of the World Championships Regulations.

(d) The Championship Committee may order an Interim championship bout when the Champion is incapacitated, inactive, or when a Champion is moving out of his division to fight for another championship. In this case the interim Champion must defend his interim title against the Champion, if the Champion who vacated his Title due to disability is medically able and prepared to compete for the Championship within 180 days of the Interim Championship. If an interim Championship is held due to a Champion’s inactivity, the Champion must defend his title against the Interim Champion within 120 days of the interim Championship or the Interim Champion shall become Champion.”

Accordingly, the WBO World Championship Committee asks that you provide the Committee with Interim Certification including your physician’s complete Psychological and/or Mental evaluation and diagnosis of your condition, your prognosis for recovery and your expected return to competition. We ask that your Interim Certification include an opinion from your physician whether it is more likely than not that you will be able to recover from your disability and retrain to competitive condition within 180 days of the onset of your condition.

We would appreciate that the physician specifically clarifies the nature and extent of your condition and your prognosis for return to training and your return to competition. If the Championship Committee does not receive the complete requested information, i.e. the Interim Certification, together with the Psychological and/or Mental Evaluation, within the allotted time frame of ten (10) days, the Committee will proceed with the necessary appropriate action without the benefit of an appeal.

The WBO wishes you the best good fortune on a prompt and speedy recovery. We looked forward to your prompt response to assist your Committee in reaching the fairest decision for you, the top contenders in the Heavyweight Division, and your future return to complete your World Championship career.

El día 26 de abril de 2014 se le autorizo a usted a pelear por el titulo vacante en la division Mosca contra la campeona Jr. Mosca Yesica Yolanda Bopp en el Polideportivo Carlos Magalot, Rio Grande, Tierra del Fuego, Argentina en la cual usted perdio por decisión unanime.

El dia 31 de enero de 2015 defendio nuevamente su titulo contra Vanesa Lorena Taborda en el Club Atletico Alba Argentina, Maciel, Santa Fe, Argentina en la cual gano por decision mayoritaria. Hizo otra defensa en Japon el 11 de noviembre de 2015 contra Tomomi Takano donde gano por la via del nocaut.

El 7 de mayo de 2016 usted combatio contra Paola Pamela Benavidez en una pelea de ocho asaltos en el Estadio F.A.B., Buenos Aires, Distrito Federal, Argentina sin la autorización del Comité de Campeonato de la Organización Mundial de Boxeo como lo estipula la sección 15 (a) del Reglamento de Campeonatos Mundiales de la Organización Mundial de Boxeo.

Ya cumplio su termino de seis meses para cumplir con su defesa obligatoria, conforme establecido en el Reglamento de Campeonatos Mundiales de la Organización Mundial de Boxeo.

Se le ordena que en los próximos cinco (5) días para que muestre causa por la cual no deba ser despojada de su título en las 115 lbs. de la O.M. B. RESOLUCIÓN DEL COMITÉ DE CAMPEONATOS DECLARANDO VACANTE EL TÍTULO JR. PLUMA FEMENINO DE LA OMB

POR CUANTO: Marcela Eliana Acuña obtuvo el Campeonato Mundial Jr. Pluma Femenino de la OMB tras derrotar a Halanna Dos Santos el 25 de octubre de 2013 por decisión unánime en combate realizado en el Club Salto Uruguayo, en Salto, Uruguay; y,

POR CUANTO: Tras dos exitosas defensas de dicho título, y a partir de la fecha de 31 de julio de 2015, este Comité de Campeonatos Mundiales de la OMB ha intentado recibir respuesta definitiva de parte de la Sra. Acuña con relación al cumplimiento de sus deberes como campeona de la OMB, ya que su última defensa del título Jr. Pluma Femenino lo fue el 23 de agosto de 2014; y,

POR CUANTO: Cuando Un boxeador desea competir por un campeonato mundial, jura, certifica y firma que ha leído, conoce y respeta los Reglamento de Campeonatos Mundiales aplicables y acepta seguir los mismos para merecer ser reconocido en la privilegiada categoría de Campeones; y,

POR CUANTO: El 1 de enero de 2016 este Comité de Campeonatos le escribió nuevamente, advirtiéndole en esta ocasión que dado a su negativa a responder procederíamos a aprobar un combate por el Campeonato Interino Jr. Pluma para el 6 de febrero de 2016 entre Sabrina Pérez y María José Núñez; y,

POR CUANTO: En la carta de 1 de enero de 2016 también le informamos a la Sr. Acuña que ésta contaría con un término de 120 días para defender su título ante la ganadora de dicho encuentro interino y que de incumplir con esta orden se reconocería a la titular interina como campeona en propiedad; y,

POR CUANTO: Posteriormente, conocimos a través de informes de prensa Marcela Acuña disputaría el cinturón interino pluma de otro organismo ante Mayra Gómez, en un combate efectuarse el 7 de mayo; y,

POR CUANTO: Ante esta noticia, nuestras oficinas contactaron a su promotor el Sr. Osvaldo Rivero quien confirmó este hecho; y,

POR CUANTO: La actitud asumida por la señora Acuña y sus manejadores representan una violación crasa de sus responsabilidades bajo los Reglamentos que juraron seguir, respetar y cumplir.

POR TANTO:  Por las razones antes esbozadas y conforme nuestro Reglamento de Campeonatos Mundiales, este Comité de Campeonatos de la OMB ha tomado la determinación:

La Organización Mundial de Boxeo (OMB), por sus siglas en ingles WBO, realizó la entrega material deportivo de Boxeo y uniformes al Gimnasio Municipal de Boxeo del Instituto Municipal de Deporte y Recreación IMDER, ubicado del Parque Satélite en San Salvador.
Son 50 los jóvenes beneficiados con la entrega de este implemento deportivo, que consiste en material para la práctica del Boxeo entre los cuales se encuentran guantes, protectores bucales, uniformes, sacos de boxeo, vendas, entre otros.
El acto se desarrollo con la asistencia de las autoridades municipales de IMDER, y contó con la participación de jóvenes beneficiados directamente con la entrega de esta donación. Asimismo se hizo un reconocimiento al Boxeador Juan Carlos “Speedy” Flores, quien recientemente debutó en el boxeo profesional con un KO en el primer round frente al nicaragüense Ricardo López.
Los miembros directivos de la Organización Mundial de Boxeo, que se hicieron presentes fueron el Dr. Luis Batista Presidente y Fundador de la OMB, el Lic. Adolfo Flores Tesorero de OMB y junto con el Lic. Oscar Canjura miembro del Comité Directivo de OMB, quienes fueron los encargados de la entrega de estos suministros y material deportivo.
El Dr. Luis Batista Salas Presidente y Fundador de OMB, explicó a todos los jóvenes. los beneficios y grandes oportunidades que se generan cuando la mente y el cuerpo están en sinfonía hacia el bien, que junto al trabajo duro hacen la diferencia en la sociedad. “…Hay que tener en cuenta que el trabajo duro da recompensas a largo plazo, no como el vació que generan distractores como las drogas, el alcohol y la juerga, que son vicios inmediatos pero vacios, que a la larga no dejan ningún beneficio en la persona. Pero el ser un deportista y llegar a ser un campeón del mundo, es un beneficio que jamás ha de terminar”.
El proyecto “Niñez Libre de Drogas” ha sido implementado por la OMB, alrededor del mundo y se realiza por medio de un trabajo conjunto con diferentes instituciones como Alcaldías, ONGS y Fundaciones que busquen ayudar a la niñez y prevenir el consumo de Drogas. Esta es ya la cuarto ocasión en el cual este organismo mundial rector del boxeo profesional hace una donación en nuestro país. Estos donativos se han realizado en diferentes lugares como Ciudad Delgado, Santa Tecla, La Escuela Militar, Asociación Probusqueda y ahora San salvador, y seguirá así con un total apoyo incondicional por parte de la OMB a la niñez Salvadoreña. I am in receipt of your February 4, 2016 letter wherein you state that given your upcoming fight against Manny Pacquiao on April 9, 2016 you are unable to comply with WBO Regulations of World Championship Contests, the WBO Championship Committee’s Resolution of November 6, 2015 (ordering the winner of Bradley vs. Rios to face WBO Mandatory Challenger Sadam Ali), and must vacate your WBO Welterweight Title.

Do know that we wholly understand your decision and commend you for always giving fans the best fights possible and doing what is best for your career at this important juncture. Estimado Campeón Guillermo Rigondeaux:

El 13 de abril del 2013 usted se coronó Campeón Junior Pluma de la OMB en el Radio City Music Hall de Nueva York, tras derrotar por decisión unánime al hasta entonces campeón Nonito Donaire. Su primera defensa del título de la OMB la realizó el 7 de diciembre de 2013, casi ocho meses después en el Boardwalk Hall de Atlantic City, Nueva Jersey ante Joseph Agbeko, derrotándolo por amplia decisión. El 19 de julio de 2014 venció a Sod Kokietgym vía nocaut en el primer asalto de un combate en el Cotai Arena, en Macao, China. Finalmente, resultó victorioso ante Hisashi Amagasa el 31 de diciembre de 2014 en el Bodymaker Colosseum en Osaka, Japón.

Desde que se convirtió en el Campeón Junior Pluma de la OMB hace treinta (30) meses, usted ha realizado únicamente tres defensas de su título habiendo celebrado la última alrededor de nueve meses y siete días.

El Comité de Campeonatos de la OMB reconoce sus grandes habilidades y todos sus logros como boxeador aficionado y profesional que lo ha llevado a ser reconocido ampliamente como uno de los mejores púgiles en la historia del boxeo. Sin embargo, es nuestro deber y obligación velar por que nuestras Reglas sean cumplidas. En su caso ni siquiera hemos ordenado una pelea mandatoria para darle más oportunidad de que pueda competir contra cualquiera de los 15 peleadores clasificados en su división de las 122 lbs. A pesar de la flexibilidad que el Comité ha tenido en su caso, usted permanece inactivo.

La Sección 20(a) de las “WBO World Regulations of World Championship Contests” establece en su parte pertinente lo siguiente:

“20(a) A World Championship may be lost for breach of contract, for disability to fight or to make the required weight, inactivity, or for any other reason established in the Regulations that govern World Championships…”

La Sección 1(b)(7) y 1(b)(21) confieren poder al Comité de Campeonatos de la WBO para recomendar al Comité Ejecutivo que un título se declare vacante. Las citadas disposiciones establecen lo siguiente:

“SECTION 1. WORLD CHAMPIONSHIP COMMITTEE

(b) The World Championship Committee shall have the following powers and discretion:

…(7) To recommend to the President and the Executive Committee that a Title should be vacated if a Champion fails to comply with the WBO World Championship Rules; and…

…(21) To vacate a championship title regardless of cause or fault if the Champion has not defended within a nine (9) month period.”

Tomando en consideración todo lo informado anteriormente le estamos concediendo un término de diez (10) días calendario para que muestre causa por la cual su título de las 122 lbs. no deba ser declarado vacante.

Se le apercibe que de usted no comparecer en el término concedido, el Comité de Campeonatos podrá resolver este asunto sin más citarle ni oírle.

ZEPEDA PETITION - RESOLUTION

RESOLUTION OF THE WORLD CHAMPIONSHIP COMMITTEE, JOSE ZEPEDA PETITION OF A RETURN FIGHT FOR THE WBO LIGHTWEIGHT TITLE

WHEREAS, on July 11, 2015 WBO #1 contender Terry Flanagan of the United Kingdom faced WBO #2 contender José Zepeda of California, United States for the vacant WBO Lightweight Championship of the World, in a bout held at the Velodrome in Manchester, U.K.; and,

WHEREAS, Zepeda suffered a dislocated left shoulder and remained on his stool at the end of the 2nd round, with Referee Marcus McDonnell waving the bout off after speaking with Zepeda’s corner team, and confirming with both the fighter and the ringside physician that the fight could not continue; and,

WHEREAS, Flanagan was deemed the winner of the contest via TKO in round 2 and was awarded the WBO Lightweight Championship of the World; and,

WHEREAS, on July 21, 2015 Mr. Robb M. Hernández, manager of José Zepeda, filed a petition with this WBO World Championship Committee, in essence requesting that we order an immediate “mandatory rematch” and alluding to Zepeda’s performance and the judges’ scoring up until the stoppage of the bout; and,

WHEREAS, Mr. Fernando Beltrán of Promociones Zanfer, Zepeda’s promoter, filed a similar request to this Committee, highlighting the “unfortunate outcome of the fight following the dislocation of Zepeda’s shoulder in the second round of the fight” and considering his fighter “worthy of a new opportunity to face Terry Flanagan in a mandatory rematch, given that the injury prevented Zepeda from continuing and proving that he can be a great WBO Champion;” and,

WHEREAS, all interested WBO participants were given notice of this Petition and allowed reasonable opportunity to express their views and submit any document or otherwise present any argument they believed would help the Committee resolve this Petition; and,

WHEREAS, the WBO World Championship Committee commissioned a five-member, highly qualified and internationally recognized, confidential judging panel to conduct a in-depth analysis of the fight, with particular emphasis on round 2; and,

WHEREAS, this judging panel saw no irregularity or misapplication of the rules, as Section 26 (b) (11) of our WBO Regulations of World Championship Contests (incorporating by reference the Uniform rules of the Association of Boxing Commissioners) is clear insofar that “[i]f a boxer sustains an injury from a fair blow and the injury is severe enough to terminate the bout, the injured boxer shall lose by TKO” (Emphasis added); and,

WHEREAS, Section 18 of the aforementioned Regulations (on Return Fights) states that “[t]he WBO shall not allow direct return fights, unless recommended by the World Championship Committee and authorized by the Executive Committee. A direct return fight is a fight between the new Champion and the former Champion from whom the new Champion won the title (or between a new Champion and the losing Contestant in a Vacant Title Fight), before the new Champion defends his title against any of the other fighters classified in his category. If the World Championship Committee determines either that the resolution of a Championship Contest was substantially irregular, or that there was a clear misapplication of the rules of boxing resulting in a manifest unfairness, such that in either case the World Championship Committee determines that the Championship was substantially unresolved, the World Championship Committee may, in its discretion, recommend a direct return fight, which may be authorized only by the majority vote of the Executive Committee […];” and,

WHEREAS, this WBO World Championship Committee sanctioned the WBO Vacant Lightweight Championship bout between Terry Flanagan and José Zepeda on June 22, 2015, provided that the winner face the WBO Mandatory Challenger within 120 days of the bout.

NOW, THEREFORE, BE IT RESOLVED by the WBO World Championship Committee that given all of the above we do not find the resolution of this Championship Contest “substantially irregular,’ [or] “that there was a clear misapplication of the rules of boxing resulting in a manifest unfairness” and that it hereby denies this petition for an immediate or “return” rematch, per the WBO World Championship Rules.

This is a final decision of the WBO World Championship Committee. The affected WBO Participant may appeal to the Complaint and Grievance Committee, pursuant to WBO World Championship Section 34, which as per Rule 3(e) of the WBO Appeals Regulation, must be submitted in writing to the WBO President within fourteen (14) days of the date of this decision as its sole and exclusive remedy.

Please be advised of WBO Female Boxing Rules and Regulations: Upon winning a WBO Female title, the champion has one hundred eighty (180) days from the date the title was obtained and /or her last title defense to defend again, or the title may be declared vacant.

You won the vacant WBO Female Jr. Middleweight title on December 20, 2014 at the El San Juan Resort and Casino in Carolina, Puerto Rico. Your title defense was due on or before June 20, 2015.

Please be advised you have ten (10) days upon receipt of this communication to provide copies of finalized fight contracts and to show cause as to why Ms. Gabriel has not defended her belt under the terms of the Championship Regulation. Re:      WBO JR. MIDDLEWEIGHT CHAMPION-SHOW CAUSE

Dear Messrs. Pelullo and DeGuardia:

The WBO World Championship Committee orders you to show cause as to why the WBO Junior Middleweight Championship of the World, currently held by Demetrius Andrade, should not be declared vacant. As you know, Section 1 (b) (7) of the WBO Regulations of World Championship Contests establishes that it is within the power and discretion of the WBO World Championship Committee “[t]o recommend to the President and the Executive Committee that a title should be vacated if a Champion fails to comply with the WBO World Championship Rules.” On the other hand per Section 5 (c) of said Regulations, “[t]he WBO World Championship Committee may, in its discretion, vacate a Champion’s title […] regardless of cause or fault if the Champion fails to defend his title within a nine (9) month period.”

Your fighter, Mr. Andrade, won the Vacant WBO Junior Middleweight title against Vanes Martirosyan at an event held at the American Bank Center in Corpus Christi, Texas, on November 9, 2013 and has defended his belt only once— more than a year ago— on June 14, 2014 at the Barclays Center in Brooklyn, New York against Brian Rose.

On September 10, 2014, this WBO World Championship Committee ruled in your favor upon receiving a petition to allow Andrade to move up in weight and immediately vie for the Vacant WBO Middleweight Championship of the World against Matt Korobov, giving sides fifteen (15) days to reach an agreement. At the end of that negotiation period on September 25, 2014, it came to our knowledge that Mr. Andrade was interested in defending his Junior Middleweight title and, therefore, wanted to stay within his division and no longer compete for Middleweight title. Mr. Andrade was next scheduled to defend his belt against Jermell Charlo on December 13, 2014 at the MGM Grand in Las Vegas, Nevada, but an agreement was never finalized and Andrade pulled out of the fight on November 17, 2014.

Then on January 23, 2015, we wrote to the both of you again advising that parties had thirty (30) days to negotiate an agreement for the WBO Junior Middleweight Championship bout between Mr. Andrade and Jermell Charlo and that a purse bid would be called if an accord was not reached within the time frame. WBO President Valcárcel subsequently received email correspondence from Mr. Pelullo on February 19, 2015 informing us that Charlo elected not to fight Andrade, but that Stephen Espinoza of Showtime was looking into Erislandy Lara as a challenger to Andrade for a date in April, but in any case no later than May.

On April 15, 2015 WBO President Valcárcel wrote to the both of you asking for confirmation of Mr. Andrade’s plans and informing that while the WBO was originally willing to allow a voluntary defense of the belt, the Junior Middleweight division could no longer be kept inactive and that a mandatory defense was in order. Mr. Pelullo promptly responded and advised that he was to meet with Mr. Andrade during that same week and that a June 29 date was set aside, potentially against Liam Smith. President Valcárcel again followed up with you on May 12, 2015 advising you of Section 20 of the WBO Regulations of World Championship Contests— PROCEDURE WHEN A TITLE IS DECLARED VACANT— and requesting that you provide the WBO with contracts for the next Andrade bout within a period of forty-eight (48) hours.

As you can see from the above, the WBO has been more than lenient with Mr. Andrade, but he has clearly been inactive and the WBO must enforce its rules. For this reason please be advised that you have a period of ten (10) days upon receipt of this communication to show cause as to why Mr. Andrade has not defended his belt under the terms of the Championship Regulations. Failure to comply with this requirement will immediately result in the WBO Jr. Middleweight Title being declared vacant, without further hearing you.
